In Oklahoma, the crime of burglary is broken into several categories.

- First-degree burglary, or home invasion: This crime occurs when a defendant enters a residence while one or more people are present. This crime is punished with imprisonment of no less than seven years and no more than 20.
- Burglary in the second degree: This crime occurs when a defendant enters any building (other than a vehicle or residence) with intent to commit a crime. This crime is punished with imprisonment of no less than two years and no more than seven and is a class B felony.
- Breaking and entering: This is a broad charge and is a misdemeanor punishable by a maximum of one year of imprisonment.
