According to the Department of Motor Vehicles:
"Impaired driving BAC between 0.05% and 0.08%:
Fine: $100 to $500
Imprisonment: Up to six months."
If you are convicted of a DUI with a BAC of more than 0.08%, the penalties are as follows:
First Offense:
- Misdemeanor charge
- Jail time of 10 days to one year
- Fine up to $1,000
Second Felony Offense:
- Felony charge
- Jail time of one to seven years
- Fine up to $5,000
Second Offense in Ten Years:
- Felony charge
- Jail time of one to five years
- Fine up to $2,500
Third Offense (and Subsequent Offenses):
- Felony charge
- Jail time of one to 10 years
- Fine up to $5,000
